Information regarding external links
It is important to distinguish between “own contents” and hyperlinks to other university services, as well as to other service suppliers. “Links” always concern “living” (dynamic) references. When the link was originally made, the University Library checked the external site’s contents to make sure it did not infringe any laws. However, the University Library does not regularly check changes of the contents of external websites, and it cannot regularly control external contents. If it is ascertained that a service, to which it has provided a link, infringes upon a civil/criminal law or might affect civil/criminal liability, the link to this site will be removed.
In spite of careful contents control, no liability will be taken for the contents of external links. Sole responsibility lies with the operators of external sites. With its verdict of 12.05.1998 “liability for links” (312 O 85/98), the Landgericht Hamburg (District Court of Hamburg) ruled that one is responsible for contents of the “linked” page or jointly responsible by attaching a link. One can prevent this by dissociating oneself clearly from these contents. In line with this, the University Library dissociates itself explicitly from all contents of all linked pages on its website. It neither has influence on the creation and contents of the linked pages, nor does it adopt these contents. This statement applies to all links and link collections, which currently exist or will exist in the future.
Storage of access data
As a rule, access data are stored for every request for information from the University Library’s website. The maximum contents that a data set contains are:
- the page, from which the file was requested
- the name of the file
- date and time of the request
- the amount of data transferred
- the access status (file transferred, file not found etc.)
- a description of the web browser used.
No user profiles are created. The stored access data can be processed according to the regulations of § 6 “Benutzungsordnung für die Informationsverarbeitungs- und Datenkommunikations-Infrastruktur der Universität Kassel” (Use Order for the Data Processing and Data Communication Infrastructure of the University of Kassel) of 18.05.1999. These access data will not be passed on to a third party.
The University Library Kassel uses - as part of its participation in the German library statistics - a method for the enumeration of visits to its website. When you call the homepage and / or the catalog pages ("OPAC" and "KARLA") as well as our services "KOBRA" and "ORKA", an identifier of the library with the target page, the date of the call and a signature of the calling host will be stored.
The signature is formed by a single function of the IP address, user agent and proxy information. The collection, storage and analysis of these data in pseudonymous form, ie the signature is not assignable to any persons. A storage, in particular the IP address, does not occur. The pseudonymous individual data are summed up after 24 hours and so anonymous.
The stored data are analyzed statistically in order to make our website as needed and to develop it further. The data will be used solely for this purpose and deleted after the evaluation.
With the technical and organizational implementation of the method the Stuttgart Media University is in charge. It has developed the method according to the requirements of the statutory provisions of the Data Protection Act and the Telemedia Act (TMG) and undertakes to respect them.
